Many public authorities and network utility operators use the “requirement” process of the Resource Management Act to “designate” sites to enable them to establish and operate their facilities without further consent from the territorial authority, and in certain circumstances to give them access to the compulsory acquisition procedure.
Designations involve significant rights and responsibilities for all parties. We advise requiring authorities (including the Ministry of Education and the Ministry of Defence), territorial authorities (including Waitakere City and Whangarei District) and private individuals on designations, including the preparation of and response to notices of requirement.
